Terms of Service

These Terms govern your use of VFR Trip Planner: the website at vfr-trip-planner.com, the VFR Trip Planner iOS app and related services (the "Service"), provided by Candelaria Racing Products LLC ("we", "us"). By creating an account or using the Service you agree to these Terms. If you don't agree, don't use the Service.

Planning aid only. Not for navigation.

The Service is a flight-planning aid. It is not an official weather briefing, is not approved by the FAA or any other authority, and must not be used for navigation. It does not replace current aeronautical charts, the Chart Supplement, NOTAMs, TFR checks, or a briefing from Flight Service (1800wxbrief.com). As pilot in command you are directly responsible for, and are the final authority as to, the operation of your aircraft (14 CFR 91.3), and you must become familiar with all available information concerning each flight (14 CFR 91.103). Verify everything the Service shows before you fly.

1. The Service and its information

The Service combines public and third-party data, including FAA airport, airspace and obstacle data, weather forecasts and observations, TFR and special use airspace information, terrain and coastline data, maps, drive times and business listings, with calculations based on the aircraft figures you enter. This information may be incomplete, out of date, delayed, or wrong, and forecasts are uncertain by nature. Routes, fuel stops, altitudes, fuel figures, weather assessments and airspace checks are estimates. We do not guarantee that any route is legal, safe, clear of airspace, terrain, obstacles or weather, or that fuel, services or businesses shown are available.

2. Accounts

You need an account to use most of the Service. You must be at least 18 years old (or the age of majority where you live) to create an account or buy a subscription. Keep your sign-in secure; you are responsible for activity under your account. Give accurate information, including your aircraft's performance figures.

3. Subscriptions, free trials and billing

  • Planning features require a paid subscription, offered monthly or yearly at the prices shown when you subscribe. Prices may change; we'll tell you before a change applies to your next renewal.
  • Free trial. New subscribers may get a free trial (currently 14 days). A payment method is required. Unless you cancel before the trial ends, your subscription starts and you are charged automatically. One trial per person.
  • Automatic renewal. Subscriptions renew automatically for the same period at the then-current price until you cancel. Cancelling stops future renewals; you keep access until the end of the period you've paid for.
  • Bought on the website: payments are processed by Stripe. Cancel or change your plan anytime from your account (Subscription). Bought in the iOS app: payments are handled by Apple under Apple's terms; manage or cancel in Settings › Apple ID › Subscriptions at least 24 hours before renewal.
  • Refunds. Payments are non-refundable and we don't give credits for partial periods, except where the law requires otherwise. Refunds for App Store purchases are handled by Apple.
  • A subscription bought on either platform unlocks the Service on both.

4. Acceptable use

You agree not to:

  • copy, resell, sublicense or redistribute the Service or its data, or use it to build a competing service;
  • scrape, crawl or access the Service by automated means, or overload or disrupt it;
  • reverse engineer the Service except as the law allows, or get around access controls or subscription checks;
  • share your account, or use the Service unlawfully or to harm others.

5. Your content

You keep ownership of what you enter (aircraft profiles, addresses, saved trips and settings). You give us permission to store and process it to provide the Service, as described in our Privacy Policy.

6. Third-party services

The Service relies on and links to third parties, such as Apple, Google, Stripe, RevenueCat, Clerk, government data sources, OpenStreetMap and ForeFlight. Their services and content are governed by their own terms, and we're not responsible for them. Restaurant, hotel and rental-car listings are for convenience only.

7. Our intellectual property

The Service, its software and design belong to us or our licensors. We grant you a personal, non-exclusive, non-transferable, revocable license to use it under these Terms. Public-domain government data remains public domain.

8. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, non-infringement and uninterrupted or error-free operation, to the fullest extent the law allows.

9. Limitation of liability

To the fullest extent the law allows, Candelaria Racing Products LLC and its members, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of life, bodily injury, property or aircraft damage, data, profits or goodwill, arising out of or related to the Service or any flight, however caused. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim.

Some places don't allow these exclusions or limits, so some of them may not apply to you.

10. Indemnity

You'll defend and indemnify Candelaria Racing Products LLC against claims, losses and costs (including reasonable attorneys' fees) arising from your use of the Service, your flights, or your breach of these Terms.

11. Suspension and termination

You can stop using the Service and delete your account at any time. We may suspend or end your access if you break these Terms or if we stop offering the Service; if we discontinue a paid Service without cause, we'll refund the unused part of your current period.

12. Changes to these Terms

We may update these Terms. We'll post the new version here with a new date and, for material changes, tell you by email or in the Service before they take effect. Continuing to use the Service after that means you accept them.

13. Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Florida, and you and we consent to their jurisdiction.

14. Apple App Store

If you use the iOS app, these terms also apply:

  • These Terms are between you and Candelaria Racing Products LLC, not Apple. Apple is not responsible for the app or its content.
  • Your license to the app is limited to Apple-branded devices you own or control, as the App Store terms allow.
  • Apple has no obligation to provide maintenance or support for the app.
  • If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the app's purchase price, if any; Apple has no other warranty obligation to the extent the law allows.
  • Apple is not responsible for claims relating to the app, including product liability, legal or regulatory compliance, consumer protection or intellectual-property claims.
  • You confirm you're not in a country under a US embargo and not on a US prohibited-parties list.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

15. General

These Terms and the Privacy Policy are the whole agreement between you and us about the Service. If a provision is unenforceable, the rest stays in effect. Our not enforcing a provision isn't a waiver. You may not transfer these Terms; we may transfer them with the Service.
